Terms and Conditions

General

These Terms constitute the agreement between you and Autonome relating to your access to and use of our Services. The failure of Autonome to exercise or enforce any right or provision of these Terms will not operate as a waiver of such rights or provision. Except as otherwise provided herein, these Terms are intended solely for the benefit of the parties and are not intended to confer third party beneficiary rights upon any other person or entity.

We believe that fundraising is a challenge rooted in poor story communication, not the finances of donors. We seek out simple and easily-integrated solutions that enable you to collect donations from old donors, tell your story to new donors, build relationships with donors, and turn donors into fundraisers, in one tool. Anyone can get started with Autonome. Our aim is to help donors make informed giving decisions and enable charities to demonstrate their commitment to making the world a better place.

Autonome provides services for non profit organizations, such as charitable organizations, non for profit events, fundraisers, and political events. By using the Autonome Services, Site and/or Application, you can use our interactive platform to support various charitable initiatives and contributing to charities. Commercially reasonable best efforts will be made by a disbursement entity to send your contributions to the charity you specify within the Application.

We are always working on new ways to improve our Services. We reserve the right to modify or change our Site, the Application or any of the Services, temporarily or permanently, with or without notice to you, and we are not obligated to support or update the Site, the Application or any Services. You acknowledge and agree that we shall not be liable to you or any third party in the event that we exercise our right to modify, change or discontinue the Site, the Application or any Services.

Eligibility

This Service is intended solely for Users who are thirteen (13) years of age or older, and any registration, use or access to the Service by anyone under thirteen (13) is strictly prohibited and in violation of this Agreement. You may use the Service only if you can form a binding contract with Autonome, and only in compliance with this Agreement and all applicable local, state, national, and international laws, rules and regulations. Accordingly, use of the Service by anyone between thirteen (13) years of age and the age of majority in such individual’s jurisdiction will require verifiable consent of such individual’s parent or legal guardian. We reserve the right to request reasonable proof of such consent, and you must provide such proof within a reasonable period of time following such request. The Service is not available to any Users previously removed from the Service by Autonome.

General Terms

Autonome’s community, like any community, functions best when its users follow a few simple rules.  By accessing and/or using the Services, you agree to comply with these community rules, including when you access Third-Party Applications through the Platform, and that: 

  • You will not use the Services for any unlawful purpose;
  • You will not upload, post, e-mail, transmit, or otherwise make available any content that:
    • infringes any copyright, trademark, right of publicity, or other proprietary rights of any person or entity; or
    • is defamatory, libelous, knowingly false, indecent, obscene, pornographic, sexually explicit, invasive of another’s privacy, promotes violence, or contains hate speech (i.e., speech that attacks or demeans a group based on race or ethnic origin, religion, disability, gender, age, veteran status, and/or sexual orientation/gender identity; or
    • discloses any sensitive information about another person, including that person’s e-mail address, postal address, phone number, credit card information, or any similar information.
  • You will not “stalk,” threaten, or otherwise harass another;
  • Please be courteous, because everyone wants to be treated with respect, and showing respect to others makes the community better for all members;
  • Don’t spam or use the Services to engage in any commercial activities, including, without limitation, raising money; advertising or promoting a product, service, website, or company; or engaging in any pyramid or other multi-tiered marketing scheme;
  • You will not access or use the Services to collect any market research for a competing businesses;
  • You will not impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity;
  • You will not interfere with or attempt to interrupt the proper operation of the Services through the use of any virus, device, information collection or transmission mechanism, software or routine, or access or attempt to gain access to any data, files, or passwords related to the Services through hacking, password or data mining, or any other means;
  • You will not cover, obscure, block, or in any way interfere with any advertisements and/or safety features (e.g., report abuse button) on the Services; and 
  • Please let us know about inappropriate content.  If you find something that violates our community guidelines, let us know, and we’ll review it (provided, however, that Autonome may not be able to and shall not be required to monitor or remove any content submitted through a Third-Party Application).

We reserve the right, in our sole and absolute discretion, to deny you access to the Services, or any portion of the Services, without notice, and to remove any content that does not adhere to these guidelines. 

Donations

All Donations made by Donors facilitated by Autonome via the App constitute a transaction between the Donor and the Charity. Autonome is not a party to such transaction, the Donation is never in the possession or control of Autonome and Autonome never knows the credit card or bank account details of the Donor. As such, Autonome accepts no responsibility to any party, including the Charity, for any loss, damage or claim made by any party in relation to the Donation made by the Donor. 

Donor Content 

Autonome shall forward all Donor Content to the Charity. By using the Autonome's services, users agree that all content, whether publicly posted or privately transmitted, is the sole responsibility of the person who has generated, transmitted, shared or posted the content. This means that users, not Autonome, are entirely responsible for all content at every stage. This includes editing, uploading, posting, sharing, emailing or otherwise transmitting or making available content via any of the services provided. Autonome does not guarantee the storage of content and is not intended as a back-up solution. Users should back-up all content they consider important. Autonome is not responsible for content that is lost or damaged.

By uploading contents (e.g. photos) to Autonome users are aware and agree that the contents uploaded to Autonome will be made available in the Autonome platform. Using Autonome products or services, users agree that it is prohibited to edit, upload, post, share, email or otherwise transmit or make available any of the following:  

  • Content that is unlawful, abusive, obscene, pornographic, profane, harmful, threatening, harassing, vulgar, defamatory, libelous, invasive of another's privacy, or hateful racially or ethnically.
  • Content that you do not have a right to edit, upload, post, share, email or otherwise transmit or make available according to any law, or due to contractual or fiduciary relationships. This includes inside information or proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements.
  • Content that could infringe copyright laws or other proprietary or intellectual property rights without the explicit permission of the owner and the persons (or their parents or legal guardians, where applicable) who are shown in the content, if applicable.
  • Any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.
  • Unsolicited or unauthorized advertising, promotional materials, "junk mail", "spam", "chain letters", "pyramid schemes", or any other similar forms of solicitation.

You acknowledge that Autonome does not pre-screen content, but that Autonome shall have the right (but not the obligation) to refuse, remove or move any content at its sole discretion, either permanently or temporarily, because that content violates the codes of conduct or regulations. Users agree to evaluate and bear all risks associated with the use of any services provided by Autonome and are responsible for any content they have edited, uploaded, posted, shared, emailed or otherwise transmitted or made available via any of the services provided, including the safety and accuracy of such content.  

Copyright

Autonome respects the intellectual property of others, and we ask our users to do the same. If you believe that your work has been copied in a way that constitutes copyright infringement, or that your intellectual property rights have been otherwise violated, please provide us with the following information:  

  • An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest.
  • A description of the copyrighted work or other intellectual property that you claim has been infringed.
  • A description of where the material in question is located, including details that will assist our staff with locating it on a specific place on the Website or in Apps.
  • Your address, telephone number, and email address.
  • A statement by you, made under penalty of perjury, that the information provided is accurate, and that you are the copyright or intellectual property owner, or authorized to act on the copyright or intellectual property owner's behalf. We may request you to provide additional information or documents to prove that you are the copyright owner of the work.

Intellectual Property Rights of Autonome Software

You acknowledge and agree that the Service and any related software used in connection with Autonome contain proprietary and confidential information that is protected by applicable intellectual property and other laws. Except as expressly authorized by Autonome, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the service or the software of Autonome, in part or in whole.

User Content

Our Services may allow you and other users to create, post, store and share content, including messages, text, photos, videos, software and other materials. User Content does not include user-generated filters. You grant Autonome a perpetual, irrevocable, nonexclusive, royalty-free, worldwide, fully-paid, transferable sub-licensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform and display your User Content and any name, username or likeness provided in connection with your User Content in all media formats and channels now known or later developed, without compensation to you. When you post or otherwise share User Content on or through our Services, you understand that your User Content and any associated information (such as your [username], location or profile photo) may be visible to the public.

You grant Autonome consent to use the User Content, regardless of whether it includes an individual’s name, likeness, voice or persona, sufficient to indicate the individual’s identity. By using the Services, you agree that the User Content may be used for commercial purposes. You further acknowledge that Autonome’s use of the User Content for commercial purposes will not result in any injury to you or to any person you authorized to act on its behalf. You acknowledge that some of the Services are supported by advertising revenue and may display advertisements and promotions, and you hereby agree that Autonome may place such advertising and promotions on the Services or on, about, or in conjunction with your User Content. The manner, mode and extent of such advertising and promotions are subject to change without specific notice to you. You acknowledge that we may not always identify paid services, sponsored content, or commercial communications as such.

You represent and warrant that: (i) you own the User Content stylized by you on or through the Services or otherwise have the right to grant the rights and licenses set forth in these Terms; (ii) you agree to pay for all royalties, fees, and any other monies owed by reason of User Content you stylize on or through the Services; and (iii) you have the legal right and capacity to enter into these Terms in your jurisdiction.

You may not create, post, store or share any User Content that violates these Terms or for which you do not have all the rights necessary to grant us the license described above. Although we have no obligation to screen, edit or monitor User Content, we may delete or remove User Content at any time and for any reason.

User Content removed from the Services may continue to be stored by Autonome, including, without limitation, in order to comply with certain legal obligations. Autonome is not a backup service and you agree that you will not rely on the Services for the purposes of User Content backup or storage. Autonome will not be liable to you for any modification, suspension, or discontinuation of the Services, or the loss of any User Content.

Limited License; Copyright and Trademark

Our Services and the text, graphics, images, photographs, videos, illustrations, trademarks, trade names, page headers, button icons, scripts, service marks, logos, slogans, filters, user generated filters and other content contained therein (collectively, the “Autonome Content”) are owned by or licensed to Autonome and are protected under international laws. Except as explicitly stated in these Terms, Autonome and our licensors reserve all rights in and to our Services and the Autonome Content. You are hereby granted a limited, nonexclusive, nontransferable, non-sub licensable, revocable license to access and use our Services and Autonome Content for your own personal use; however, such license is subject to these Terms and does not include any right to: (a) sell, resell or commercially use our Services or Autonome Content; (b) copy, reproduce, distribute, publicly perform or publicly display Autonome Content, except as expressly permitted by us or our licensors; (c) modify the Autonome Content, remove any proprietary rights notices or markings, or otherwise make any derivative uses of our Services or Autonome Content, except as expressly set forth in these Terms; (d) use any data mining, robots or similar data gathering or extraction methods; or (e) use our Services or Autonome Content other than as expressly provided in these Terms. Any use of our Services or Autonome Content other than as specifically authorized herein, without our prior written permission, is strictly prohibited and will terminate the license granted under these Terms. You will not remove, alter or conceal any copyright, trademark, service mark or other proprietary rights notices incorporated in or accompanying the Autonome Content.

Feedback

Any questions, comments, suggestions, ideas, original or creative materials or other information you submit about Autonome or our products or Services (collectively, “Feedback”), is non-confidential and will become the sole property of Autonome. We will own exclusive rights, including, without limitation, all intellectual property rights, in and to Feedback and will be entitled to the unrestricted use and dissemination of Feedback for any purpose, commercial or otherwise, without acknowledgment or compensation to you.

Indemnification

To the fullest extent permitted by applicable law, you will indemnify, defend, and hold harmless Autonome and each of our respective officers, directors, agents, partners and employees (individually and collectively, the “Autonome Parties”) from and against any loss, liability, claim, demand, damages, expenses or costs (“Claims”) arising out of or related to (a) your access to or use of our Services; (b) your User Content or Feedback; (c) your violation of these Terms; (d) your violation, misappropriation or infringement of any rights of another (including intellectual property rights or privacy rights); or (e) your conduct in connection with our Services. You agree to promptly notify Autonome Parties of any third party Claims, cooperate with Autonome Parties in defending such Claims and pay all fees, costs and expenses associated with defending such Claims (including, but not limited to, attorneys’ fees). You also agree that the Autonome Parties will have control of the defense or settlement of any third party Claims. This indemnity is in addition to, and not in lieu of, any other indemnities set forth in a written agreement between you and Autonome or the other Autonome Parties.

Disclaimers

We do not control, endorse or take responsibility for any User Content or third-party content available on or linked to by our Services. Your use of our Services is at your sole risk. Our Services are provided “as is” and “as available” without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. In addition, Autonome does not represent or warrant that our Services are accurate, complete, reliable, current or error-free. While Autonome attempts to make your access to and use of our Services safe, we cannot and do not represent or warrant that our Services or servers are free of viruses or other harmful components. You assume the entire risk as to the quality and performance of the Services.

Release

To the fullest extent permitted by applicable law, you release Autonome and the other Autonome Parties from responsibility, liability, claims, demands, and/or damages (actual and consequential) of every kind and nature, known and unknown (including, but not limited to, claims of negligence), arising out of or related to disputes between users and the acts or omissions of third parties.

Transfer and Processing Data

By accessing or using our Services, you consent to the processing, transfer and storage of information about you in and to Sweden and other countries, where you may not have the same rights and protections as you do under local law.

Conduct

You acknowledge and agree that all information, data, text, images, software, music, sounds, graphics, video, messages, tags and other materials, in whatever form and technical structure using the Service (“Content”), are the sole responsibility of the person(s) originating such Content and introducing such Content into the Service. We reserve the right, but shall have no obligation, to pre-screen, reject, review, quarantine, delete or move any Content available with the Service for any reason and without liability to any person. You agree that you are responsible for your own conduct and all conduct under your account, and all Content that is created, transmitted, stored or displayed by anyone using your Account Information with the Service and for any consequences arising as a result thereof. You agree to use the Service only for purposes that are legal, proper and in accordance with these Terms of Service, and all applicable laws and regulations in the relevant legal jurisdictions (including, without limitation, laws and regulations relating to the recording of audio/audio visual content, copyright laws, defamation laws, privacy laws and the storage and transmission of data and technology). Without limiting the foregoing, you shall be deemed to represent and warrant to Autonome that you have the unfettered legal rights and authority to permit you to submit your Content to Autonome in connection with your use of the Service, and such submission and the grant to Autonome of the rights you grant herein in connection with Autonome’s offering and operation of the Service does not infringe the rights of any person or third party.

Please ensure that you are mindful of the legal rights of others in copyrightable works, trade marks and service marks and their individual privacy, and do not reproduce or upload or publish Content that will breach their rights or subject you to legal liability. Autonome cannot and will not provide you legal or other advice on these issues, but will act in accordance with applicable law and in the best interests of Autonome and, in its discretion, the interests of those who use the Service. We encourage you to obtain advice from a lawyer familiar with such issues if you are unsure of your rights to upload, distribute or publish any Content on the Service By using the Service and accepting the Terms of Service, you confirm that you are at least 16 years old.

You agree that if you choose to share your Content from Autonome on a third-party site or service, you do so at your own risk, and you understand that this Agreement and Autonome’s Privacy Policy do not apply to your use of such sites

By submitting to Autonome any ideas, suggestions, documents and/or proposals through the “Feedback” interface or otherwise (collectively, “Contributions”), you acknowledge and agree that: (a) your Contributions do not contain confidential or proprietary information; (b) Autonome is not under any obligation of confidentiality, express or implied, with respect to the Contributions; (c) Autonome shall be entitled to use or disclose (or choose not to use or disclose) such Contributions for any purpose, in any way, in any media worldwide; (d) Autonome may have something similar to the Contributions already under consideration or in development; (e) your Contributions automatically become the property of Autonome without any obligation of Autonome to you; and (f) you are not entitled to any accounting, compensation or reimbursement of any kind from Autonome under any circumstances.

You further agree to NOT:

  • use our products or the Service for illegal purposes or for promotion of dangerous or illegal activities;
  • impersonate any person or entity, including, but not limited to, an Autonome staff member, or falsely state or otherwise misrepresent your affiliation with Autonome or any other person or entity;
  • forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the Service;
  • upload, post or otherwise transmit any Content that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
  • upload, post or otherwise transmit any Content that infringes any patent, trade mark, trade secret, database, copyright or other proprietary rights of any party;
  • upload, post or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes” or any other form of solicitation; (j) upload, post or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
  • interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected or applicable to the Service;
  • breach any applicable local, county, national or international law;
  • “stalk” or otherwise harass another person or company, or take any action invasive to another’s privacy (by posting, for example, another’s photograph, address, email, phone number or any other contact information) without permission from such other person;
  • collect or store personal data about other users for commercial purposes;
  • promote or provide instructional information about illegal activities, promote physical harm or injury against any government, legal entity, group or individual, or promote any act of cruelty to animals, including, but not limited to, providing instructions on how to assemble explosive device or other weapons or incendiary devices; and
  • allow usage by others in such a way as to violate these Terms of Service.

These Terms of Service constitute the entire agreement between you and Autonome and governs your use of the Service. These Terms of Service, as in effect from time to time, supersedes any prior agreements or earlier versions of these Terms of Service between you and Autonome for the use of the Service. If, through accessing or using the Service, you utilize or obtain any product or service from a third party, you may additionally be subject to such third party’s terms and conditions applicable thereto, and these Terms of Service shall not affect your legal relationship with such third party.

The Autonome community cares for each other, and is often a place where people facing difficult issues come together to create awareness or find support. Thank you for helping us create one of the best communities in the world. We want Autonome to be an authentic and safe place for inspiration, expression, peace and prosperity. Our goal is to improve the condition of the planet and address global challenges in universal solidarity. Help us foster this community.

Autonome is a reflection of our diverse community of cultures, ages, and beliefs. We’ve spent a lot of time thinking about the different points of view that create a safe and open environment for everyone.

We created the Community Guidelines so you can help us foster and protect this amazing community. By using Autonome, you agree to these guidelines and our Policy. We’re committed to these guidelines and we hope you are too. Overstepping these boundaries may result in deleted content, disabled accounts or other restrictions.

We are stronger as a community

Each of us is an important part of the Autonome community. If you see something that you think may violate our guidelines, please alert us. We have a global team that reviews these reports and works as quickly as possible to remove content that doesn’t meet our guidelines. Even if you or someone you know doesn’t have an Autonome account, you can still alert us. When you complete the report, try to provide as much information as possible, such as links, usernames, and descriptions of the content, so we can find and review it quickly. We may remove entire posts if either the imagery or associated captions violate our guidelines.

  • You may find content you don’t like, but doesn’t violate the Community Guidelines. If that happens, you can unfollow or block the person who posted it. If there's something you don't like in a comment on one of your posts, you can delete that comment.
  • Many disputes and misunderstandings can be resolved directly between members of the community. If one of your photos or videos was posted by someone else, you could try commenting on the post and asking the person to take it down. Don't target the person who posted it by posting screenshots and drawing attention to the situation because that may be classified as harassment.
  • We may work with law enforcement, including when we believe that there’s risk of physical harm or threat to public safety.

Collection of Information

Some areas of the Site may ask you to submit personal information in order for you to benefit from the specified features or to participate in a particular activity.  You will be informed what information is required and what information is optional. We may combine the information you submit with other information we have collected from you, whether on- or offline.  We may also combine it with information we receive about you from other sources, including information from your publicly available social media profiles, and other third parties.

When you first register to use the Service, you will be prompted to create a password. Unless you had previously logged out of the Service or are signing into the Service from another device, you will not need to enter your login information (username and password) when you open and access the Service. You must keep your password secret and not give it to anyone else or let them use your account. You must not use anyone else’s password or account. You must inform us immediately if you suspect any unauthorized use of or access to your password or account. We will not be responsible if you suffer any harm or loss because you do not keep your password secret, if you let someone else use your account, if you use someone else’s password or account, or if you become aware of or suspect unauthorized use of your password or account but do not tell us promptly.

Upon downloading the Licensed Application to your mobile device, you will be required to create an account in order to participate. Once you’ve created an account, you can donate to a cause, view the gallery of donated photos, view a list of causes that you can help, and manage your account settings. In order to make a donation, tap on the [ ] button in the [ ] of the navigation. From there, choose from a list of provided causes. Charities may cease to participate and new charities may be introduced to the Service. We also reserve the right to determine any minimum or maximum Donation amounts payable to the charities.

You agree that We may collect and use technical data and related information, including but not limited to technical information about your device, system and application software, and peripherals. We may use this information, as long as it is in a form that does not personally identify you, to improve our products or to provide services or technologies to you. Our collection and use of other information provided in connection with the Service that does personally identify you will be subject to the Privacy Policy included as part of Service.

We have the right to review all Photographs, captions or other material submitted and We may (but are not required to) reject or remove any Photographs, captions or other material you submit that We consider breaches any of these Guidelines and Restrictions. We do not guarantee to identify and remove any Photographs, caption or other material that breach these Guidelines and Restrictions. If you submit any Photographs which include images of any third parties who are personally identifiable, you must have obtained the prior informed permission of the third parties to submit such Photographs for the purposes of the Program. You are solely responsible for all Photographs, captions or other material that you submit for posting and We are not responsible for any loss or harm you may suffer as a result of submitting any Photograph, captions or other material, whether it breaches the Guidelines and Restrictions or otherwise.

IP Address:  Your IP Address is a number that is automatically assigned to the computer that you are using by your Internet Service Provider.  An IP Address is identified and logged automatically in our server log files whenever a user visits the Site, along with the time of the visit and the page(s) that were visited.  Collecting IP Addresses is standard practice on the Internet and is done automatically by many web sites.  We use IP Addresses for purposes such as calculating Site usage levels, helping diagnose server problems, and administering the Site.

Device Information:  We may collect information about your mobile device, such as a unique device identifier.

How We Use and Disclose Information

We use and disclose information you provide to us as described to you at the point of collection.

In addition, we use and disclose information collected through the Site as we believe to be necessary or appropriate:  (a) as permitted by applicable law, including laws outside your country of residence; (b) to comply with legal process; (c) to respond to requests from public and government authorities, including public and government authorities outside your country of residence; (d) to enforce our terms and conditions; (e) to protect our operations or those of any of our affiliates; (f) to protect our rights, privacy, safety, or property, and/or that of our affiliates, you, or others; and (g) to allow us to pursue available remedies or limit the damages that we may sustain.  We may also use and disclose information collected through the Site in other ways, with your consent.

General Guidelines

Only share photos and videos that you have rights to share.

As always, you own the content you post on Autonome. Remember to post authentic content, and don’t post anything you’ve copied or collected from the Internet that you don’t have the right to post. Post only your own photos and always follow the law. Respect everyone on Autonome, don’t spam people or post nudity.

Only post appropriate photos.

We know that there are times when people might want to share nude images that are artistic or creative in nature, but for a variety of reasons, we don’t allow nudity on Autonome. People like to share photos or videos of their children. For safety reasons, there are times when we may remove images that show nude or partially-nude children. Even when this content is shared with good intentions, it could be used by others in unanticipated ways.

We encourage meaningful and genuine interactions.

Help us stay spam-free by not artificially collecting likes, followers, or shares, posting repetitive comments or content, or repeatedly contacting people for commercial purposes without their consent.

Don’t breach the law.

Autonome is not a place to support or praise terrorism, organized crime, or hate groups. Offering sexual services, buying or selling firearms and illegal or prescription drugs is also not allowed. We have zero tolerance when it comes to sharing sexual content involving minors or threatening to post intimate images of others.

Respect Autonome Community Members.

We want to foster a positive, diverse community. We remove content that contains credible threats or hate speech, content that targets private individuals to degrade or shame them, personal information meant to blackmail or harass someone, and repeated unwanted messages. We do generally allow stronger conversation around people who are featured in the news or have a large public audience due to their profession or chosen activities. Refrain from violence or attacks against anyone based on their race, ethnicity, national origin, sex, gender, gender identity, sexual orientation, religious affiliation, disabilities, or diseases. We understand that many people use Autonome to share important and newsworthy events. Some of these issues can involve graphic images. Because so many different people and age groups use Autonome, we may remove images of intense, graphic violence to make sure Autonome stays appropriate for everyone. We understand that people often share this kind of content to condemn, raise awareness or educate. If you do share content for these reasons, we encourage you to caption your photo with a warning about graphic violence. Sharing graphic images for sadistic pleasure or to glorify violence is never allowed.

General Terms

  1. You are solely responsible for your conduct and any data, text, files, information, usernames, images, graphics, photos, profiles, audio and video clips, sounds, musical works, works of authorship, applications, links and other content or materials (collectively, "Content") that you submit, post or display on or via the Service.
  2. You must not change, modify, adapt or alter the Service or change, modify or alter another website so as to falsely imply that it is associated with the Service.
  3. You must not create or submit unwanted email, comments, likes or other forms of commercial or harassing communications ("spam") to any Autonome users.
  4. You must not use domain names or web URLs in your username without prior written consent from Autonome.
  5. You must not interfere or disrupt the Service or servers or networks connected to the Service, including by transmitting any worms, viruses, spyware, malware or any other code of a destructive or disruptive nature. You may not inject content or code or otherwise alter or interfere with the way any Autonome page is rendered or displayed in a user's browser or device.
  6. You must not create accounts with the Service through unauthorized means, including but not limited to, by using an automated device, script, bot, spider, crawler or scraper.
  7. You must not attempt to restrict another user from using or enjoying the Service and you must not encourage or facilitate violations of these Terms of Use or any other Autonome terms.
  8. Violation of these Terms of Use may, in Autonome’s sole discretion, result in termination of your Autonome account. You understand and agree that Autonome cannot and will not be responsible for the Content posted on the Service and you use the Service at your own risk. If you violate the letter or spirit of these Terms of Use, or otherwise create risk or possible legal exposure for Autonome, we can stop providing all or part of the Service to you.

General Conditions

  1. We reserve the right to modify or terminate the Service or your access to the Service for any reason, without notice, at any time, and without liability to you. If we terminate your access to the Service or you use the form detailed above to deactivate your account, your photos, comments, likes, friendships, and all other data will no longer be accessible through your account (e.g., users will not be able to navigate to your username and view your photos), but those materials and data may persist and appear within the Service (e.g., if your Content has been re-shared by others).
  2. Upon termination, all licenses and other rights granted to you in these Terms of Use will immediately cease.
  3. We reserve the right, in our sole discretion, to change these Terms of Use ("Updated Terms") from time to time. Unless we make a change for legal or administrative reasons, we will provide reasonable advance notice before the Updated Terms become effective.
  4. You are solely responsible for your interaction with other users of the Service, whether online or offline. You agree that Autonome is not responsible or liable for the conduct of any user. Autonome reserves the right, but has no obligation, to monitor or become involved in disputes between you and other users. Exercise common sense and your best judgment when interacting with others, including when you submit or post Content or any personal or other information.
  5. You agree that you are responsible for all data charges you incur through use of the Service.
  6. We prohibit crawling, scraping, caching or otherwise accessing any content on the Service via automated means, including but not limited to, user profiles and photos (except as may be the result of standard search engine protocols or technologies used by a search engine with Autonome’s express consent).

General Rights

  1. Autonome does not claim ownership of any Content that you post on or through the Service. Instead, you hereby grant to Autonome a non-exclusive, fully paid and royalty-free, transferable, sub-licensable, worldwide license to use the Content that you post on or through the Service, subject to the Service's Privacy Policy. Some of the Service is supported by advertising revenue and may display advertisements and promotions, and you hereby agree that Autonome may place such advertising and promotions on the Service or on, about, or in conjunction with your Content. The manner, mode and extent of such advertising and promotions are subject to change without specific notice to you.
  2. You acknowledge that we may not always identify paid services, sponsored content, or commercial communications as such.
  3. You represent and warrant that: (i) you own the Content posted by you on or through the Service or otherwise have the right to grant the rights and licenses set forth in these Terms of Use; (ii) the posting and use of your Content on or through the Service does not violate, misappropriate or infringe on the rights of any third party, including, without limitation, privacy rights, publicity rights, copyrights, trademark and/or other intellectual property rights; (iii) you agree to pay for all royalties, fees, and any other monies owed by reason of Content you post on or through the Service; and (iv) you have the legal right and capacity to enter into these Terms of Use in your jurisdiction.

Autonome Content is protected by copyright, trademark, patent, trade secret and other laws, and, as between you and Autonome, Autonome owns and retains all rights in the Autonome Content and the Service. You will not remove, alter or conceal any copyright, trademark, service mark or other proprietary rights notices incorporated in or accompanying the Autonome Content and you will not reproduce, modify, adapt, prepare derivative works based on, perform, display, publish, distribute, transmit, broadcast, sell, license or otherwise exploit the Autonome Content.
  5. The Autonome name and logo are trademarks of Autonome, and may not be copied, imitated or used, in whole or in part, without the prior written permission of Autonome. In addition, all page headers, custom graphics, button icons and scripts are service marks, trademarks and/or trade dress of Autonome, and may not be copied, imitated or used, in whole or in part, without prior written permission from Autonome.
  6. Although it is Autonome's intention for the Service to be available as much as possible, there will be occasions when the Service may be interrupted, including, without limitation, for scheduled maintenance or upgrades, for emergency repairs, or due to failure of telecommunications links and/or equipment. Also, Autonome reserves the right to remove any Content from the Service for any reason, without prior notice. Content removed from the Service may continue to be stored by Autonome, including, without limitation, in order to comply with certain legal obligations, but may not be retrievable without a valid court order. Consequently, Autonome encourages you to maintain your own backup of your Content. In other words, Autonome is not a backup service and you agree that you will not rely on the Service for the purposes of Content backup or storage. Autonome will not be liable to you for any modification, suspension, or discontinuation of the Services, or the loss of any Content. You also acknowledge that the Internet may be subject to breaches of security and that the submission of Content or other information may not be secure.
  7. You agree that Autonome is not responsible for, and does not endorse, Content posted within the Service. Autonome does not have any obligation to prescreen, monitor, edit, or remove any Content. If your Content violates these Terms of Use, you may bear legal responsibility for that Content.

It is Autonome's policy not to accept or consider content, information, ideas, suggestions or other materials other than those we have specifically requested and to which certain specific terms, conditions and requirements may apply. This is to avoid any misunderstandings if your ideas are similar to those we have developed or are developing independently. Accordingly, Autonome does not accept unsolicited materials or ideas, and takes no responsibility for any materials or ideas so transmitted. If, despite our policy, you choose to send us content, information, ideas, suggestions, or other materials, you further agree that Autonome is free to use any such content, information, ideas, suggestions or other materials, for any purposes whatsoever, including, without limitation, developing and marketing products and services, without any liability or payment of any kind to you.

Reporting Copyright and Other IP Violations

  1. We respect other people's rights, and expect you to do the same.
  2. If you repeatedly infringe other people's intellectual property rights, we will disable your account when appropriate.

TO THE FULLEST EXTENT PERMISSIBLE BY LAW, NEITHER AUTONOME NOR ITS PARENT COMPANY NOR ANY OF THEIR EMPLOYEES, MANAGERS, OFFICERS OR AGENTS (COLLECTIVELY, THE ”AUTONOME PARTIES") MAKE ANY REPRESENTATIONS OR WARRANTIES OR ENDORSEMENTS OF ANY KIND WHATSOEVER, EXPRESS OR IMPLIED, AS TO: (A) THE SERVICE; (B) THE AUTONOME CONTENT; (C) USER CONTENT; OR (D) SECURITY ASSOCIATED WITH THE TRANSMISSION OF INFORMATION TO AUTONOME OR VIA THE SERVICE. IN ADDITION, THE AUTONOME PARTIES HEREBY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, CUSTOM, TRADE, QUIET ENJOYMENT, SYSTEM INTEGRATION AND FREEDOM FROM COMPUTER VIRUS.

THE AUTONOME PARTIES DO NOT REPRESENT OR WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED; THAT DEFECTS WILL BE CORRECTED; OR THAT THE SERVICE OR THE SERVER THAT MAKES THE SERVICE AVAILABLE IS FREE FROM ANY HARMFUL COMPONENTS, INCLUDING, WITHOUT LIMITATION, VIRUSES. THE AUTONOME PARTIES DO NOT MAKE ANY REPRESENTATIONS OR WARRANTIES THAT THE INFORMATION (INCLUDING ANY INSTRUCTIONS) ON THE SERVICE IS ACCURATE, COMPLETE, OR USEFUL. YOU ACKNOWLEDGE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. Limitation of Liability; Waiver

IN NO EVENT WILL THE AUTONOME PARTIES BE LIABLE TO YOU OR ANYONE ELSE FOR LOSS, DAMAGE OR INJURY, INCLUDING, WITHOUT LIMITATION, DEATH OR PERSONAL INJURY.

YOU AGREE THAT IN THE EVENT YOU INCUR ANY DAMAGES, LOSSES OR INJURIES THAT ARISE OUT OF AUTONOME'S ACTS OR OMISSIONS, THE DAMAGES, IF ANY, CAUSED TO YOU ARE NOT IRREPARABLE OR SUFFICIENT TO ENTITLE YOU TO AN INJUNCTION PREVENTING ANY EXPLOITATION OF ANY WEB SITE, SERVICE, PROPERTY, PRODUCT OR OTHER CONTENT OWNED OR CONTROLLED BY THE AUTONOME PARTIES, AND YOU WILL HAVE NO RIGHTS TO ENJOIN OR RESTRAIN THE DEVELOPMENT, PRODUCTION, DISTRIBUTION, ADVERTISING, EXHIBITION OR EXPLOITATION OF ANY WEB SITE, PROPERTY, PRODUCT, SERVICE, OR OTHER CONTENT OWNED OR CONTROLLED BY THE AUTONOME PARTIES.

BY ACCESSING THE SERVICE, YOU UNDERSTAND THAT YOU MAY BE WAIVING RIGHTS WITH RESPECT TO CLAIMS THAT ARE AT THIS TIME UNKNOWN OR UNSUSPECTED, AND IN ACCORDANCE WITH SUCH WAIVER, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND, AND HEREBY EXPRESSLY WAIVE, THE BENEFITS OF SECTION 1542 OF THE CIVIL CODE OF CALIFORNIA, AND ANY SIMILAR LAW OF ANY STATE OR TERRITORY, WHICH PROVIDES AS FOLLOWS: "A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR."

AUTONOME IS NOT RESPONSIBLE FOR THE ACTIONS, CONTENT, INFORMATION, OR DATA OF THIRD PARTIES, AND YOU RELEASE US, OUR DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS FROM ANY CLAIMS AND DAMAGES, KNOWN AND UNKNOWN, ARISING OUT OF OR IN ANY WAY CONNECTED WITH ANY CLAIM YOU HAVE AGAINST ANY SUCH THIRD PARTIES.

Indemnification

You (and also any third party for whom you operate an account or activity on the Service) agree to defend (at Autonome's request), indemnify and hold the Autonome Parties harmless from and against any claims, liabilities, damages, losses, and expenses, including without limitation, reasonable attorney's fees and costs, arising out of or in any way connected with any of the following (including as a result of your direct activities on the Service or those conducted on your behalf): (i) your Content or your access to or use of the Service; (ii) your breach or alleged breach of these Terms of Use; (iii) your violation of any third-party right, including without limitation, any intellectual property right, publicity, confidentiality, property or privacy right; (iv) your violation of any laws, rules, regulations, codes, statutes, ordinances or orders of any governmental and quasi-governmental authorities, including, without limitation, all regulatory, administrative and legislative authorities; or (v) any misrepresentation made by you. You will cooperate as fully required by Autonome in the defense of any claim. Autonome reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you, and you will not in any event settle any claim without the prior written consent of Autonome.

Entire Agreement

If you are using the Service on behalf of a legal entity, you represent that you are authorized to enter into an agreement on behalf of that legal entity. These Terms of Use constitute the entire agreement between you and Autonome and governs your use of the Service, superseding any prior agreements between you and Autonome. You will not assign the Terms of Use or assign any rights or delegate any obligations hereunder, in whole or in part, whether voluntarily or by operation of law, without the prior written consent of Autonome. Any purported assignment or delegation by you without the appropriate prior written consent of Autonome will be null and void. Autonome may assign these Terms of Use or any rights hereunder without your consent. If any provision of these Terms of Use is found by a court of competent jurisdiction to be invalid or otherwise unenforceable, the parties nevertheless agree that such portion will be deemed severable from these Terms of Use and will not affect the validity and enforceability of the remaining provisions, and the remaining provisions of the Terms of Use remain in full force and effect. Neither the course of conduct between the parties nor trade practice will act to modify the Terms of Use. These Terms of Use do not confer any third-party beneficiary rights.
